The present general terms and conditions (hereinafter: "GTC") apply to the legal relationship between LE BOUCHON International GmbH, Thun (CHE-270.578.015) (hereinafter: "LE BOUCHON") and the buyers of the web shop operated by it (www.le-bouchon.ch) (hereinafter: "buyer").

The aim of the GTCs is to inform the purchaser of the terms of the contract, in particular the purchase, delivery and replacement of defective products.

By placing an order, the Buyer acknowledges the validity of the GTC.

1.) Sales price, invoicing, payment options
All prices are quoted in Swiss Francs (CHF) and include the respective sales tax. Delivery costs are not included in the prices on the website. The delivery costs are regulated under point 6 of the GTC and are to be borne by the buyer.

We accept the following payment methods: PostFinance Card, PostFinance e-finance, Visa, MasterCard, bank transfer using e-banking or, in the case of regular customers, the Postal Check (BVR) provided with the wines ordered.

Cash payment is only possible when collecting the wine at LE BOUCHON's warehouse. The buyer must make an appointment with LE BOUCHON for this purpose.

2.) Validity of the prices and the contract
At all times the prices stated on the website at the time of the order shall apply. We reserve the right to make changes in the following cases: Changes to the stock, the vintage, the offer, the availability of the wines or clear errors or typing errors. Claims for damages are excluded in the case of clear errors and typing mistakes.

3.) Reservation of the right of ownership
LE BOUCHON retains the right of ownership of the products until full payment of the purchase price. In case of late payment, the right to withdraw from the contract is reserved.

4.) Order procedure
The buyer can browse the website operated by LE BOUCHON (www.le-bouchon.ch) and add products to the shopping basket as he wishes. The purchase is subject to registration. During registration, the buyer must provide his name, address, e-mail address and telephone number.

The buyer can then log into his account with his e-mail address and password. The buyer can start the purchase process by placing the products to be purchased in the shopping cart. The buyer is guided by the system through the purchase process, during which he/she can choose the method of payment and delivery. A contract of sale is established between the buyer and LE BOUCHON by the sending of the order and its confirmation by LE BOUCHON.

The delivery dates may vary depending on the delivery addresses.

During the purchase, the buyer will be able to correct at any time any errors in the electronically recorded data (product, quantity, personal details, delivery address, etc.).

The information relating to the order is automatically confirmed by sending an e-mail to the e-mail address provided by the buyer, where the buyer can check the order details. Orders are recorded by us under the order number in the confirmation.

The contract will be stored in LE BOUCHON's online system and will remain accessible at a later date and will also be sent to the e-mail address provided by the buyer.

5.) Withdrawal from the order
The order can be cancelled by the buyer free of charge before delivery.

The buyer may also cancel the order when the delivery process has started, but in this case 30% of the invoice amount and the delivery costs must be paid to our company. Furthermore, the delivered wines must be returned to us undamaged and at our own expense or, by prior agreement, be left in our warehouse.

6.) Delivery
The costs for delivery are not included in the prices, delivery costs will be invoiced separately. A delivery is only accepted in Switzerland.

Orders are delivered by our logistics partner as soon as possible, usually (but not guaranteed) in 3-6 working days.

Delivery costs:

CHF 1,00-98,90 order value: CHF 10,00.

Free delivery from CHF 99.00 order value.

The products can be collected from the Le BOUCHON warehouse at a pre-arranged time without delivery and packaging costs.

7.) Guarantee
The buyer is obliged to check the information in our return confirmation immediately and to inform LE BOUCHON of any errors found within 2 working days.

In accordance with the decision of the Swiss Wine Trade Association of 10.06.1988 or Art. 197 of the Federal Law on the Swiss Code of Obligations:

wines bottled in Switzerland can be exchanged or refunded within one year of purchase; wines from other countries are not exchanged or refunded only if LE BOUCHON is the exclusive distributor (in this case within two years of purchase).

The bottle returned by the buyer must be up to 2/3 full and must have the original stopper. The faulty product will be returned by the buyer to LE BOUCHON at his own expense.

The faulty wine can be replaced if it is in stock. If we do not have the wine to be replaced in stock, the buyer will be offered a replacement wine. If the buyer does not accept the replacement wine, he/she may choose to have the purchase price of the faulty wine recorded by LE BOUCHON and redeem it at a later purchase or have it refunded. Repayment will be made by transfer to the bank account indicated by the buyer.

Bordeaux wines of all types are sold at the buyer's own risk ("Buyers risk"). The risk of a wine defect in these wines is borne by the Buyer.

8.) Sale to young people
The sale of wine to young people under the age of 16 or the sale of spirits to young people under the age of 18 is prohibited by law. In order to fully comply with the law, we reserve the right to ask questions about the age of the buyer, if necessary, or to request documents to prove age at any time during the purchase. By sending the order, the buyer expressly declares that he/she meets the legal requirements of the purchase.

9.) Illustration of the product
The photos of the individual wines may differ from the product described, so please always read the relevant product description carefully. In any case, the pictures are for information purposes only.

10.) Security of personal data
The personal information provided to us by the buyer will be treated confidentially in accordance with the federal law on data protection and will not be passed on to third parties without the buyer's permission.

11.) Security on the Internet
The online order is protected by SSL code, which guarantees the integrity of the transmitted data.

12.) Disclaimer
In compliance with the legal framework, the liability of LE BOUCHON or its employees and any compensation for the buyer is excluded, except for point 7 of the general terms and conditions.

13.) Copyright
The website, graphics, images and texts are all the property of LE BOUCHON and are protected by intellectual property rights.

14.) Amendment
The general terms and conditions can be changed at any time - even without prior notice.

15.) Applicable law and place of jurisdiction
The valid Swiss law is applicable. For any legal disputes, the place of jurisdiction is the registered office of LE BOUCHON.
